色法官審判爭議時力提3修法

【台灣醒報記者譚有勝台北報導】針對前法官陳鴻斌性騷擾助理案再審輕判爭議，職務法庭全由法官組成，不但有官官相護的弊端，退休法官還能領錢，恐有司法不公的疑慮，時代力量立委黃國昌、徐永明13日召開記者會批評現行《法官法》，並提出包括職務法庭引入公正人士參審；退休、離職法官退休金、離職給與應追回等3項修改條文，以確保司法公正。

前法官陳鴻斌性騷擾助理案再審案，全由法官組成的職務法庭，令外界認為司法院官官相護，難以公正審判不適任法官而呼籲修法。民間司改會早前更建議司法法制委員會參考「國民法官」制度，讓人民參與職務法庭審判，以確保人民監督司法審判之公正性。

時代力量13日也召開記者會呼籲修改《法官法》。立委徐永明表示，現行《法官法》規定，法官被彈劾後仍可領取退休金，顯不然合理。這次陳鴻斌法官事件更有官官相護的疑慮，唯有非職務法官監督司法，才能完善不適任法官的淘汰機制，建立民眾對司法的信心。

立委黃國昌則說，淘汰不適任的法官一直是《法官法》的訴求。2011年《法官法》立法時就有很多學者提出要修正，淘汰機制必須讓外部人員參與才合理。過去更曾發生最高法院的法官為酒駕兒子關說，公務懲戒委員會最後只讓該法官休息一段時間。雖然民進黨支持修改《法官法》，最終卻因司法院及國民黨反對而最終沒有修法。

黃國昌也說，《法官法》不適任法官淘汰機制仍有很大的漏洞。他舉例，年初司法院曾主動移送2位法官，其中一位已經完成退休程序。即使監察院彈劾，因該法官已退休只是罰款，事後退休金完全不受影響。他批評，「這個制度讓違法的法官聽到風聲後就趕快辦理退休，懲戒機制形同虛設。」因此，時代力量提出3項修正條文，並呼籲司法法制委員會將《法官法》列為本會期優先修改的法案。

第一，針對《法官法》第48條，職務法庭應由職務法官3人及參審法官4人組成合議庭行之，並議自身職業法官為審判長。所謂參審法官，需由司法院法官委員會推薦長期參與司法改革、人權、公益或弱勢議題的社會公正人士。

第二，針對《法官法》第49條，退休、或因其他原因離職的法官於退休、離職後亦適用之。第三，針對《法官》第50條，受懲戒人離職前所有任職年資的退休金、退養金等應追回之。
